Sibu man fined RM10,000 for abusing noisy 9-year-old brother-in-law

SIBU (Oct 11): A 35-year-old man was fined RM10,000 in default eight months in prison today by the Sessions Court here for abusing his nine-year-old brother-in-law.

Judge Musyiri Peet convicted the man on his own guilty plea to a charge under Section 31(1)(a) of the Child Act 2001, which provides for a maximum fine of RM50,000, or up to 20 years imprisonment, or both upon conviction.

Musyiri ordered the man to be placed on a two-year good behaviour bond of RM5,000 (undeposited) and one surety.

He also ordered the man to undergo 100 hours of community service within six months from the date of order with a bond of RM5,000 (undeposited) in one surety.

In addition, the court shall execute a good behaviour bond with sureties for a period and condition as the court thinks fit and an order to perform community service of between 36 and 240 hours within a six-month period from the date of the order.

Based on the charge, the man, who was supposed to take care of the victim, abused the child by knocking him on the head, pinching his ear, and slamming him onto the floor on Oct 6 at around 2pm at a house here.

The investigation found the man committed the offence because the child had made a loud noise while he was trying to sleep.

The victim was under the man’s care because his mother was in Mukah while his sister was working.

As a result of the attack, the victim had several wounds on the back-right side of his head, behind his ear, and hand.

The victim had to be admitted to Sibu Hospital for treatment.

Deputy public prosecutor Mohamad Amirul Hakim Mohamad Zamri prosecuted the case, while the man did not have legal representation.
