Man ordered to defend charge of raping daughter
by The Borneo Post · Borneo Post OnlineKOTA KINABALU (Oct 30) : A 45-year-old man was ordered by a Sessions Court here to enter defence on a charge of raping his daughter.
Judge Elsie Primus made the order on the man after she ruled that the prosecution had established a prima facie case against him.
The man was accused of raping his daughter, who was 11 years old then at an unnumbered house in Inanam at 1.57pm on December 30, 2021.
The alleged offence was under Section 376 (3) of the Penal Code which provides for a jail term of up to 30 years and whipping, upon conviction.
The court fixed December 5 for the hearing of the defence stage.
In the meantime, the accused who was represented by counsel Mohd Al Hafidz Mohd Lokman, is further detained in custody.
The prosecution had called seven witnesses to testify against him.
